1Acceptance of Terms

Welcome to TripMate ("we," "our," or "us"). By accessing or using our website at tripmate.es (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old or have parental consent to use the Service.

2Account Terms

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for:

  • Maintaining the security of your account and password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate your account if we suspect any unauthorized use or breach of security.

By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Use, reproduce, and distribute your User Content
  • Modify and adapt your User Content for technical purposes
  • Display your User Content if you make it public

You represent and warrant that: (1) you own or have the necessary rights to your User Content, (2) your User Content does not violate the privacy rights, publicity rights, copyrights, or other rights of any person.

5Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of TripMate and its licensors.

The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6Subscriptions and Billing

Some parts of the Service are billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis.

Payment:

  • You must provide current, complete, and accurate billing information
  • You must promptly update all payment information
  • Subscriptions automatically renew unless canceled before the renewal date

Cancellation:

  • You can cancel your Subscription at any time through your account settings
  • Cancellation takes effect at the end of the current Billing Cycle
  • No refunds for partial months or years

Refunds:

  • Annual subscriptions: 30-day money-back guarantee
  • Monthly subscriptions: No refunds, but you can cancel anytime

7Free Trial

TripMate may offer a free trial for new paid plans. At the end of the free trial period, you will be charged the applicable subscription fee unless you cancel before the trial ends.

We reserve the right to modify or cancel free trial offers at any time without prior notice and to limit who can participate in free trials.

8Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account from settings.

All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TRIPMATE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from using the Service will be accurate or reliable.

10Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRIPMATE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

12Governing Law

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Spain.
